DOCTOR:LEGAL REQUIREMENT

Your Doctor owes you a duty of care because it's reasonably foreseeable that if he negligently under-assesses the risk of you having CCSVI, an internationally recognized and well documented condition, then he is willfully neglecting to offer you a legal duty of care.

As your registered doctor, he has a legal responsibility within this doctor/patient relationship to protect you from foreseeable dangers, and protect you from reasonably foreseeable events.

CCSVI is a vascular condition found in over 50% MS patients tested (Buffalo study).

What Do The Buffalo Results Mean?

In another study of 8983 patients it was deemed that vascular damage increases the severity of MS.

The buffalo study highlight that MS patients are twice as likely to have CCSVI than healthy patients.

Validity of CCSVI

At the Consensus Conference on Venous Malformations, headed by Prof. BB Lee from Washington, experts from 47 countries unanimously voted in favor of officially including the stenosing lesions found in CCSVI in the new Consensus document and Guidelines on account of the submitted angiographic evidence and scientific documentation

If your Doctor Say's No

If your doctor cannot understand the need to protect you from the vascular condition, ask him to refer you to a qualified vascular specialist. As your doctor, he is under a legal obligation to offer an acceptable duty of care.

Failing that, seek legal advice and take appropriate action based on these grounds.

MS Society Medical Advisors comments on CCSVI

They have provided the following statement (on the 4th of December 2009) for people interested in seeking treatment for CCSVI.

" We are not convinced by the evidence that blockages to draining veins from the brain are specific to people with multiple sclerosis, or that this explains the cause of multiple sclerosis at any stage of the condition."

"We are all agreed that people with multiple sclerosis are not likely to benefit by treatments that dilate blood vessels and consider these procedures to carry risks with no evidence for benefit. "

"The treatment for CCSVI is not available for patients with multiple sclerosis in the United Kingdom because there is no convincing evidence to suggest that it is safe or beneficial to people with MS." 

(This statement was available on MS Society websites April 6th, 2010, four months after the "MS Medical Advisors" decided upon themselves speak for MS patients, "they were not convinced by CCSVI")

What Kinds of Things Can I Sue a Charity For?

" If your state allows lawsuits against charities, you may bring tort actions against them just as would against other private organizations. Some examples include personal injuries, injuries from negligence, nuisances created by the charity, fraud, libel, and slander. Additionally, you can always sue a charity for any intentional injuries. "

National MS Society Public Advocacy - Section 501(c)

At the National Multiple Sclerosis Society, “advocacy” encompasses efforts to influence the public and private sectors to obtain benefits and resources for people with multiple sclerosis (MS) and their families. Most of the advocacy is directed toward the public sector, where they work largely with the legislative branch of federal, state, and local units of governments. Public sector advocacy also may require activity in the executive and judicial branches of government. All Society public policy advocacy relates to medical research, health care, long-term care, health insurance, and disability issues.

There are many public policies and programs that greatly influence the health, health care, health insurance, and well-being of people with MS.

People with MS expect that the National MS Society will represent their interests when important public policy matters are considered or when private businesses act in a way that harms people with MS. The chapters and home office share this responsibility.

At the National MS Society, there is a partnership between chapters and the home office; the various responsibilities for advocacy are shared.
